Terms of Service

These Terms of Service govern your access to and use of the Pilates by Renata website, online studio, workouts, programmes, community features and related services.

The service is operated by:

**Renata Patricia Pereira, trading as Pilates by Renata**
Hermitage 135
1506 TX Zaandam
The Netherlands

KVK number: 98662155
VAT identification number: NL005345614B92
Email: [[email protected]](mailto:[email protected])

By creating an account, purchasing a membership or using the service, you agree to these Terms.

## 2. Eligibility and lawful access

You must be at least 18 years old to create an account, purchase a membership, participate in community features or submit content to Pilates by Renata.

People between 13 and 17 years old may participate in workouts only under the supervision and responsibility of a parent or legal guardian who holds the relevant account and has determined that the exercise is suitable for them.

Children under 13 should not use the service or participate in its workouts.

The service is intended primarily for adults. Certain workouts, including workouts involving weights or equipment, may not be appropriate for minors.

Pilates by Renata does not represent that the service is lawful, appropriate or available in every country, state or territory. Access may be restricted or prohibited in certain locations.

When accessing or using the service, you are responsible for complying with the laws and regulations that apply in your location.

## 3. The service

Pilates by Renata provides online fitness and educational content, which may include:

* Prerecorded Pilates and strength-based workouts
* Mobility and flexibility classes
* Programmes and workout calendars
* General fitness education
* General nutrition education and meal guidance
* Community features and member discussions
* Occasional responses or guidance from Renata

The service does not include medical care, physiotherapy, dietetic treatment or individually supervised personal training unless explicitly stated otherwise.

We may add, remove, replace or update classes, programmes, instructors, features and equipment recommendations from time to time.

## 4. Memberships and pricing

Available memberships, prices, billing periods and included features are shown before purchase.

Current or promotional prices may include:

* Founding membership: USD $11.99 per month
* Introductory or early-bird membership: USD $17.99 per month
* Standard monthly membership: USD $24.99 per month

Prices shown at checkout control if they differ from examples stated elsewhere.

Applicable taxes, currency conversion charges or payment-provider fees may be added where required and will be shown or explained before payment where applicable.

## 5. Founding membership

A founding membership price remains available only while the founding member maintains an uninterrupted active subscription.

If a founding member cancels, allows the subscription to expire or loses access because payment cannot be collected, the founding price is forfeited.

A former founding member who later rejoins must pay the membership price available at the time of rejoining.

The founding price applies to the membership level originally purchased. It does not automatically include future premium services, separate products, individual coaching or higher membership tiers.

## 6. Automatic renewal and payment

Paid memberships renew automatically at the end of each applicable billing period unless cancelled before the next renewal date.

By purchasing a recurring membership, you authorise the applicable payment provider to charge the payment method selected at checkout for each renewal.

You are responsible for keeping your payment and billing information accurate and current.

If payment fails, we or our payment provider may retry the payment, restrict access or suspend the membership until the outstanding payment is resolved.

## 7. Price changes

We may change membership prices.

Existing members will receive at least 30 days’ advance notice before a price increase applies to their recurring membership, unless a shorter period is required because of a change in law, tax or another circumstance outside our reasonable control.

You may cancel before the new price takes effect.

A price described expressly as a lifetime founding price will continue while the qualifying founding subscription remains uninterrupted, subject to applicable law and any exceptional change that makes continuing the original arrangement impossible or unlawful.

## 8. Cancelling a membership

You may cancel your membership at any time through the cancellation method made available in your account or on the website.

Cancellation stops the next automatic renewal. Unless otherwise stated or required by law:

* You will not be charged for a new billing period after an effective cancellation.
* You will retain access until the end of the billing period you have already paid for.
* Cancellation does not normally result in a prorated refund for unused days.
* Access ends when the paid billing period expires.

Memberships cannot currently be paused unless a pause option is expressly made available through the platform.

Contact [[email protected]](mailto:[email protected]) if you experience difficulty cancelling.

## 9. Statutory right of withdrawal

Consumers may have a statutory right to withdraw from an online purchase within 14 days without giving a reason, particularly under European consumer law.

The withdrawal period generally begins on the day the service contract is concluded.

If you ask for access to begin during the 14-day withdrawal period, the legal treatment of any refund may depend on:

* The type of service supplied
* The amount of the service already supplied
* Whether you expressly requested immediate performance
* Whether you received and acknowledged the required withdrawal information
* The mandatory consumer law that applies to you

Nothing in these Terms limits a statutory withdrawal, refund, repair, price-reduction or other consumer right that cannot lawfully be excluded.

You may exercise an applicable right of withdrawal using the withdrawal function provided on our website, by emailing [[email protected]](mailto:[email protected]), or by using the model form at the end of these Terms.

## 10. Refund policy

Except where required by applicable law, membership payments are non-refundable once charged.

This means that:

* Cancelling prevents future renewals but does not normally refund the current billing period.
* We do not normally provide partial refunds for unused membership time.
* Forgetting to cancel before renewal does not automatically entitle you to a refund.
* Prior use of the seven-day free access does not remove any mandatory consumer rights.

We may consider refunds in exceptional circumstances, including duplicate charges, confirmed billing errors or prolonged service failure.

Nothing in this section overrides rights that cannot legally be waived.

## 11. Seven-day free access

Pilates by Renata may offer seven days of free access to a selected collection of classes.

Unless stated otherwise:

* No payment card is required.
* The offer does not automatically convert into a paid membership.
* Access expires automatically after seven days.
* The offer includes only the selected classes identified for the promotion.
* Other studio content may be visible but unavailable.
* The offer may only be claimed once per person.
* The offer is personal and may not be shared.
* We may change, suspend or withdraw the offer.

A separate paid membership must be purchased if you wish to continue after the free-access period.

## 12. Personal and non-transferable access

Your account and membership are for your personal use only.

You must not:

* Share your account or login details
* Allow another person to use your membership
* Sell, transfer or sublicense access
* Circumvent access restrictions
* Use another member’s account

You are responsible for activity occurring through your account and should contact us promptly if you believe it has been accessed without permission.

## 13. Intellectual property

All workouts, videos, audio, programmes, schedules, written materials, branding, graphics, photographs and other service content are owned by or licensed to Pilates by Renata and are protected by intellectual-property laws.

Your membership gives you a limited, personal, non-exclusive, non-transferable and revocable right to stream the content for your own non-commercial use.

You must not:

* Download content unless a download feature is expressly provided
* Screen-record or otherwise copy workouts
* Reproduce or redistribute content
* Repost clips or classes
* Publicly display or perform the content
* Sell, rent, sublicense or commercially exploit it
* Remove copyright notices or branding
* Use the content to train or provide services to other people
* Create competing products based substantially on our materials

## 14. Member content and testimonials

You retain ownership of comments, photographs, testimonials, progress updates and other content you submit.

By posting content within the platform or community, you grant Pilates by Renata a non-exclusive licence to host, store, reproduce and display that content as reasonably necessary to operate, moderate and provide the service.

Posting within the membership does not automatically give us permission to use identifiable content in public marketing.

We will request additional permission before using identifiable member photographs, progress updates, testimonials or community posts on public websites, social media, marketing emails or advertisements.

You confirm that content you submit:

* Belongs to you or is submitted with permission
* Does not violate another person’s privacy or rights
* Is not unlawful, abusive, discriminatory or misleading
* Does not contain unauthorised commercial promotions
* Does not include sensitive information about another person without permission

We may remove content that breaches these Terms or that we reasonably consider unsafe, inappropriate or damaging to the community.

## 15. Community conduct

When using community features, you must treat other members and Pilates by Renata representatives respectfully.

You must not:

* Harass, threaten or abuse another person
* Publish another person’s private information
* Give dangerous medical or fitness instructions
* Promote unrelated products or services without permission
* Impersonate another person
* Upload malware or interfere with the platform
* Encourage eating-disorder behaviours, dangerous exercise or other harmful conduct

Community content represents the views of individual users and is not necessarily endorsed by Pilates by Renata.

## 16. Health and safety

The workouts and educational materials are provided for general fitness and informational purposes.

You are responsible for deciding whether a workout is suitable for you. Before beginning, read the Fitness and Nutrition Disclaimer available on our website.

You should consult an appropriately qualified healthcare professional before starting or continuing a programme if you:

* Are pregnant or postpartum
* Are injured or recovering from surgery
* Have a medical condition
* Experience unexplained pain or symptoms
* Have concerns about your ability to exercise safely

Stop exercising and seek appropriate assistance if you experience pain, dizziness, faintness, chest pain, unusual shortness of breath or another concerning symptom.

## 17. No guaranteed results

Individual results vary.

Pilates by Renata does not guarantee weight loss, muscle gain, body-composition changes, pain relief, improved health or any other specific physical or nutritional result.

Results depend on many factors, including consistency, ability, health, sleep, nutrition, lifestyle and individual circumstances.

## 18. Suspension and termination

We may restrict, suspend or terminate access when we reasonably believe that you have:

* Shared an account
* Copied or distributed content
* Failed to pay
* Abused another member or representative
* Misused the community
* Violated these Terms
* Used the service unlawfully or fraudulently

Where appropriate, we may first give you an opportunity to correct the issue.

Serious or repeated violations may result in immediate termination. Termination resulting from your material breach does not automatically entitle you to a refund.

You may terminate your agreement by cancelling your membership.

## 19. Service availability

We aim to keep the service reasonably available but cannot promise uninterrupted or error-free access.

Access may be interrupted because of:

* Maintenance
* Technical faults
* Internet or hosting failures
* Third-party platform problems
* Security issues
* Events outside our reasonable control

We may make reasonable changes needed to maintain, secure or improve the service.

If a significant failure prevents you from accessing the paid service for an extended period, contact [[email protected]](mailto:[email protected]).

## 20. Third-party services

The service may rely on or link to third-party platforms, payment providers, video hosts and community tools.

Their own terms and privacy policies may also apply. Pilates by Renata is not responsible for third-party services outside our reasonable control, although this does not affect responsibilities we cannot lawfully exclude.

## 21. Liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for intentional misconduct, gross negligence or mandatory consumer rights.

To the extent permitted by law, Pilates by Renata is not responsible for:

* Loss caused by ignoring safety instructions
* Injury caused by using unsuitable equipment or an unsafe exercise area
* Use of the service contrary to professional medical advice
* Unauthorised account use caused by your failure to protect login details
* Indirect or unforeseeable losses
* Commercial losses arising from personal use of the service

You remain responsible for exercising within your own ability and circumstances.

## 22. Changes to these Terms

We may update these Terms to reflect changes to the service, law, technology or business operations.

Material changes affecting an active paid membership will be communicated in advance where reasonably possible.

If you do not agree to a material change, you may cancel before it takes effect. Changes do not remove mandatory rights that have already arisen.

## 23. Governing law

These Terms are governed by the laws of the Netherlands.

This choice of law does not remove any mandatory consumer protection available to you under the laws of your country of residence.

Disputes may be submitted to the competent courts of the Netherlands, subject to any mandatory right a consumer has to bring or defend proceedings elsewhere.
